These Terms of Service (“Terms”) are entered into between Matthew (the “Coach/Provider”, “we”, “us”, “our”, “me”), who will register a business entity in New York, and you, the user (“you”, “your”). By accessing or using https://enspiredwellness.com, you agree to be bound by these Terms.
2. Service Overview
Enspired Wellness provides online health and personal‑training sessions grounded in neuroscience. Sessions are delivered remotely (video call, phone, or other electronic means). A complimentary introductory session is offered to new clients. All subsequent sessions are scheduled and paid for through direct email or video communication; no payment processing occurs on the website.
3. Eligibility
You must be at least 13 years old and capable of entering into a binding agreement. If you are under 18, you must obtain parental or guardian consent before booking a session.
4. Booking & Payment
- Booking – Sessions are booked by emailing us. We will confirm the appointment via a confirmation email.
- Payment – Fees for paid sessions are discussed and agreed upon in subsequent email or video correspondence. Payment methods are arranged outside the website.
- Rescheduling / Cancellation – You may request a reschedule by replying to the confirmation email. We will accommodate reasonable requests when possible.
5. Complimentary Introductory Session
The first introductory session is provided free of charge. It is intended solely for an initial assessment and does not constitute a guarantee of future services.
6. Email Communications & Data Retention
- We will send you a confirmation email after each booking, as well as reminder or follow‑up emails as needed.
- Your name, email address, phone number, and any messages you send will be stored solely for personal contact and service delivery.
- We will not share your personal information with third parties except as required by law or to fulfill the service (e.g., sending session links).

7. Video‑Session Privacy
- No recordings – All live video coaching sessions are never recorded by us.
- Privacy‑first video platform – We use a video‑call service that provides end‑to‑end encryption (E2EE)by default.
- Alternative services – If you prefer a different video platform, we can switch to that service provided it also meets strong privacy standards. We will confirm the chosen platform with you before the session begins.
8. Disclaimer & Limitation of Liability
- The information, advice, and instructions provided during sessions are for educational and motivational purposes only. They do not constitute medical, psychological, legal, or financial advice. You should consult a qualified professional for any health‑related concerns.
- Enspired Wellness makes no warranties regarding the accuracy, completeness, or suitability of any content or advice.
- To the fullest extent permitted by law, Enspired Wellness shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the use of our services, even if we have been advised of the possibility of such damages.
9. Cancellation by Enspired Wellness
If we must cancel a scheduled session due to illness, emergency, or any other unavoidable circumstance, we will notify you as soon as possible by email and will work with you to reschedule or provide a refund for any prepaid fees.
10. Force Majeure
Neither party shall be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, governmental actions, or Internet outages.
11. Dispute Resolution
Any dispute arising out of or relating to these Terms or the services provided shall be resolved through non‑binding mediation conducted in New York, United States. If mediation fails, either party may pursue any legal remedy available in the courts of New York State.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict‑of‑law principles.
13. Changes to These Terms
We may update or modify these Terms at any time. Revised versions will be posted on this page, and the “Effective Date” will be amended. Continued use of the site or further email communication after changes constitute your acceptance of the updated Terms.
